18 U.S.C. §2257 Record-Keeping Requirements Compliance Statement

All models, actors, actresses, and other persons that appear in any visual depiction of actual sexually explicit conduct on QueerFlame were over the age of eighteen (18) years at the time those visual depictions were created.

Platform-produced content

With respect to visual depictions produced or directly published by the operators of QueerFlame, records required under 18 U.S.C. §2257 and 28 C.F.R. 75 are maintained by the Custodian of Records below.

User-generated content (UGC)

QueerFlame is a user-generated content platform. Users must confirm they are at least 18 at registration. Uploaders represent and warrant that:

• They are at least 18 years of age;
• All persons depicted in their uploads were at least 18 when the content was created;
• They have the legal right to publish the content; and
• They will maintain any records required by applicable law.

For user-generated depictions, the uploader is the primary custodian of records under 18 U.S.C. §2257. QueerFlame may assist rights holders and authorities by forwarding requests when feasible.

Exempt depictions

Depictions that do not portray actual sexually explicit conduct under 18 U.S.C. §2256(2)(A)–(D), or that qualify for other exemptions under 28 C.F.R. Part 75, are not subject to §2257 record-keeping.
